1Agreement

These Terms are a contract between you and Ankita Sahu, sole proprietor, India (“Pestren”, “we”). By using pestren.com, interface.pestren.com, socials.pestren.com, our API or any report we produce, you accept them. If you are accepting on behalf of a company, you confirm you are authorised to bind it, and “you” means that company.

2What Pestren is

Pestren is land due-diligence infrastructure. It assembles public and licensed datasets about a parcel — soil surveys, climate and hydrology records, cadastral and ownership data, land cover, hazard and environmental records, satellite imagery — and produces cited reports and machine-assisted analysis.

4Accuracy, sources and AI output

Our reports rest on third-party public data — federal, state, county and municipal records, and their foreign equivalents. That data can be outdated, incomplete, mis-georeferenced or simply wrong, and we do not control it. We show you the source and vintage of each fact so you can judge it. We do not warrant the accuracy, completeness or currency of any dataset or of any report.

The Assistant uses a large language model. It is instructed to answer only from cited facts and to say when something is missing, but like all such systems it can be wrong, can misread a figure, and can present a regional average as if it described your parcel. Treat its output as a draft to be checked against the citations, never as a finding. Where a report distinguishes a parcel-level measurement from a regional aggregate, that distinction is material and you must respect it.

5Eligibility and restricted regions

You must be at least 18 and legally able to contract. You may not use Pestren if you are located in, ordinarily resident in, or acting for a person in a country or region subject to comprehensive sanctions or export restrictions applicable to us, or if you appear on a restricted-party list. We may refuse or withdraw service on that basis, and our waitlist already screens for it.

6Accounts, invites and quotas

• Keep your credentials secure; you are responsible for activity under your account.
• An invite code is personal to you. It binds to the first IP address that redeems it and may not be shared, resold or published. Sharing it is grounds for immediate revocation.
• Free and invited accounts carry quotas — on fields, parcels per selection, Assistant questions per day and in total, and report downloads. We may adjust quotas, and we will not reduce a paid plan’s quota mid-term.
• We may suspend or close an account for breach of these Terms, for abuse, or where we are legally required to.

7Acceptable use

You agree not to:

• scrape, crawl or bulk-extract the service, or evade rate limits, quotas or the invite gate;
• resell, redistribute or sub-licence reports or underlying data as a competing dataset or product;
• reverse-engineer the service, or use its output to train a competing model;
• upload anything unlawful, infringing, malicious, or containing another person’s personal data you have no right to share;
• use Pestren to make a decision about a person — creditworthiness, tenancy, employment or insurance eligibility. It is a tool for assessing land.

8Your content and your data

You keep ownership of everything you put in — boundaries, notes, management records, uploads. You grant us a non-exclusive, worldwide licence to host, process and display that content solely to operate the service for you: to compute analytics, generate your reports, and store your history. That licence ends when you delete the content or your account, subject to the retention periods in the Privacy Policy.

We do not use your content to train models, and we do not licence it to anyone else.

Feedback is different. If you send us feedback, suggestions or ideas, you grant us a perpetual, worldwide, royalty-free, non-exclusive licence to use and build on them without compensation or attribution. This lets us act on what you tell us, and protects us when two people suggest the same thing.

Publishing a chat makes it public. A published transcript is readable by anyone with the link, without signing in, and may be indexed. You are responsible for what you publish.

9Our intellectual property

The software, models, prompts, report structure, design and the Pestren name and marks are ours. Reports we generate are licensed to you for your own business use, including sharing with your advisers, counterparties and lenders on a specific transaction — but not for republication as a product or dataset. Underlying public data remains subject to its own source licence, which we identify in the citations.

10Fees

Pestren is currently in a free, invite-only preview and nothing is charged. When paid plans launch, the prices, inclusions and billing terms in the Refund & Cancellation Policy apply and form part of these Terms. Prices are exclusive of GST and any other applicable tax, which we will add where required.

11Availability

Pestren is provided on an “as available” basis. We do not guarantee uptime during the preview, and we may change, suspend or discontinue features. A third-party data source may go offline, change its terms, or block us at any time — when it does, the affected report section degrades honestly rather than silently guessing. For paid plans, if a service level applies it will be stated in your order.

12Warranties and liability

To the fullest extent the law allows, the service and all reports are provided “as is” and “as available”, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost opportunity, lost data, or any loss arising from a transaction you entered into or declined in reliance on a report. Our total aggregate liability is capped at the greater of (a) the amount you paid us in the 12 months before the claim, or (b) ₹25,000. During the free preview, where you have paid nothing, limb (b) applies.

Nothing here excludes liability that cannot lawfully be excluded — including for fraud, or for death or personal injury caused by negligence — and nothing limits the rights you have as a consumer under the Consumer Protection Act, 2019 or equivalent mandatory law where you live.

13Indemnity

You will indemnify us against third-party claims arising from your breach of these Terms, your misuse of the service, content you upload or publish, or your use of a report in a transaction. This does not apply to claims caused by our own breach or negligence.

14Termination

You may stop using Pestren and delete your account at any time. We may terminate for material breach, giving notice and a chance to fix it where the breach can be fixed. On termination your licence to use the service ends; you keep reports already delivered; and clauses 3, 4, 8 (feedback), 9, 12, 13 and 16 survive. You may export your field data before you go, and for 30 days after.

15Changes to these Terms

We may update these Terms. For material changes we will give account holders at least 14 days’ notice by email or in-product, and continuing to use Pestren after that means you accept them. If you do not, stop using the service and — if you are on a paid plan — contact us for a pro-rata refund of the unused term.

16Governing law and disputes

These Terms are governed by the laws of India. The courts of India have exclusive jurisdiction, except that a consumer may bring proceedings in their own place of residence where mandatory local law gives them that right. Talk to us first at core@pestren.com — most things are resolved there.
